Crime and Disorder Act

The 1998 Crime and Disorder Act applies in Scotland, England, Wales and Northern Ireland; in Scotland, it is amended by provisions in the Criminal Justice (Scotland) Act 2003. This legislation is relevant in relation to the earlier discussion of the limits of confidentiality.

Section 115 of the Crime and Disorder Act 1998 gives power – but not an automatic right or obligation – to disclose information to specified relevant authorities (e.g. those engaged in Crime Prevention Work) where the disclosure is necessary or expedient for the purposes of that Act.
