Anti-Terrorism, Crime and Security Act

The Anti-Terrorism, Crime and Security Act 2001 applies in applies in Scotland, England, Wales and Northern Ireland. Section 17 of the Act extends certain existing disclosure powers to include specified purposes relating to criminal investigations and proceedings. Potentially, the Act could be used to require the disclosure of information by or on behalf of a public authority (which could include a higher or further education institution), and is thus relevant to our discussion about the limits of confidentiality.

As with all the legislation described in this section, you are advised to seek specific legal advice (through your organisation’s research office) where necessary.
